I am not sure what my status is at present.

I re-entered in US in Dec 12th 2007 with the I-94 stamped as valid till duration of H1. My H1 Visa expired on Feb 6th 2008.

My company lawyer has filed for my H1 extension in Nov 2007 and I am still waiting.

I do have the EAD permit and the AP which I presume is not being used at present.

Please provide some guidance. My lawyer is not responding.

They need to have EAD with no expiry. There is no reason for the EAD to expire except getting your GC. Same for AP.

How about getting DENIED a green card? That's the whole idea of having expiration on EAD - so that people can't extend after they have been denied. And getting the money, too. EAD fees are #1 money makers for USCIS.

I am a july 2nd filer and my AP shows "Document mailed to applicant on Oct30", but EAD still shows "Pending" , anybody else in this situation ?
I took infopass last tuesday so maybe they approved AP but EAD still pending, isnt this strange ?

It would be ten times better if you would personally call them or meet them personally and get answers for your questions :) Does that sound reasonable?? Many of our american disilusioned brothers/sisters are visiting our site periodically/regularly to see what we are upto. They think their salaries will rise once H1b visas are eliminated. "How Sad". Thanks glus, I'll try filing the I 102 - hopefully they had computerized records back in the dark ages when I arrived. Also I'm hoping there's a record somewhere of the visa extension filed by my lawyer - do you think the same form might dig that up?

Shatunup, what's a CIR? I'm intrigued....

I have spoken to an attorney and the overstay is not really the issue - because I'm legitimately married (we have a two year old!) and if we can prove it's not a green card marriage I believe I just have to pay a fine.... however they do require proof of legal entry, which I don't have. You can adjust your status in the US if you are married to a US citizen - in fact I have to because if I leave the country I'm subject to the 10 year ban and they won't let me back in married or not.

I have a new passport but without the visa and entry stamp it doesn't really help!

Hi,

I am in need of some advice. I am on first h1b extension with 2.5 hears left. I have an MS but was filed under eb3 with priority date of march 2005 (didn't knew about priority categories at that time). Now I am feeling a bit stagnant in my current job, but have always felt myself constrained thinking about restarting the GC process from zero. Given the current eb3 condition and my priority date what would you suggest I should do? Switch job, get a salary raise, restart under eb2 or continue doing whatever I do hoping eb3 will become current in some reasonable time and i'll be free ?

no offense garfield, many of us here hate to give any suggestions/advice, if we see an empty profile. why dont you update your profile first. time and again many of us have asked many people who come up with a new thread first post asking advice for their individual situation, i would urge everyone here to stop advicing/suggesting anyone who does not have their profile complete. I have similar question about EB2 and experience with current employer

I came from China, so EB3 are really bad comparing with EB2

As I know I could not use experience at my current employer (Company A) to fill EB2, can I find a consulting company (Company B) who willing to sponsor my EB2, while still work for Company A (through Company B)?

Yes. You can find a company B and ask them to process your case in EB2. Remember, GC is for future employment not current. So you can work for company A whereas your processing under EB2 thru company B can go ahead. However, you will need to join company B at some point in time. This is what my company B told me. I believe it is once you file your 485 but I am not sure.

I am not 100% sure on this reply ....

As soon as you use EAD, your H1B status is voided. I have read that if you have worked less then 6 months on EAD then there are chances that you could get back on the same H1.

Now, once 6 months (180) days have passed, your unused H1 is supposed to get cancelled.

You may want to check with some good attorney though.

USCIS is sick of active IVian and they want them to suffer. These active IVian have PD earlier than 2006. I am one of them.
How come most of the 2006 PD holders getting approved? I do not have any grudge against who have 2006 PD and got their AOS approved. I am just wondering as to what is making USCIS to choose only 2006 PD ? Definitely, the low hanging fruits theory does not seem to be working here. Anybody has any idea about that ? I am just frustrated.

either way .. you can not file because I485 because ur PD is 2008, so need to wait for awhile (not sure when). please check visa bulletin every month. if it reach your PD then you can file for I485.

Please give the entire facts of the case before asking for advise.
1. You said your I-140 is cleared, that means u might be working currently or did they apply as future employee
2. What does your master's have to do with your EB3 application? if you already filed in Eb3 and your date is current there is no point in waiting for completion of the masters and then filing in EB2. Either the attorney is drunk or you are not giving the entire information.

Please give all relevant info and hopefully somebody can guide you. If you feel your attorney is messing you up, you can file for your 485 by yourself if you company agrees.

either way we need more details to help you dude

As per the last revised visa bulletin, the extension period for filling I-485 is Aug 17. But it talks about only I485 and not about I-140.

So can anyone confirm, if one can file I-140 and I-485 concurrently from Aug 1 to Aug 17.
