    Some 63,000 flights had been canceled in Europe by the end of Sunday, in the four days since the air space of northern Europe was shut down by an enormous ash cloud from an erupting volcano beneath the Eyjafjallajokull glacier in Iceland.

    Passengers are scrambling to find alternative travel routes. German tourists are being bussed home from Spain, while the Royal Navy is sending military ships to Spain to bring home stranded Brits. Thousand of Europeans are also stuck in the US with no option to leave at this time. Many visitors are worried about the implications of not being able to leave before their current status expires.

    Foreign nationals stranded in the U.S. because of the airport closures in Europe due to the Icelandic volcano eruption and who are about to exceed their authorized stay in the U.S. have two avenues for relief. If at an airport and traveling under the Visa Waiver Program (VWP), they should contact the U.S. Customs and Border Protection office at the airport. They may also contact the local U.S. Citizenship and Immigration Services office. Both Department of Homeland Security agencies have provided their staff and offices with guidance on the applicable legal authorities under the VWP in circumstances such as this.

    Persons traveling under a visa should contact the nearest USCIS office and follow the instructions below. While these instructions recommend initiating the process 45 days in advance, USCIS is providing reminder guidance on how to handle such cases until normal flights are scheduled between the U.S. and foreign countries affected by the Icelandic volcanic activity.

    My friend with july-07 filer (I-140 approved in Jan-07) lost H1 in Mar-08 and work on EAD and his company move to new address in May-09. USCIS site visit on Aug-09 to old address for H1-b (one year ext) for his co-worker. His co-worker got letter form USCIS to submit documents in Dec-09 for existance of the Company. Company inform everyone in Nov-09 that it is going out of business and shutting down operation in Dec-09.

    What are the options my friend and his co-worker with (LC/I-140 approved form another company) have??

    Your friend and his co-worker has to find another job in same/similar field as soon as possible and file AC21 with the new employer.

    Hi,
    I am leaving company A to join Company B. My first 3 year term of H1 is expiring with company A soon in the next 6 months.

    1. Do I have to apply just H-1 transfer or (H-1 Transfer + H1 extension) with company B?
    2. Is there any number of weeks or period that I can be with out any pay stubs from company A after I leave them before I join company B? Will I fall 'out of status' as soon as the company A stops running pay stubs (they may not revoke immediately as my 3 yr H-1 is expiring with them soon anyway)? I am asking this because the company B may take a couple of weeks to employ me and start paying me.
    3. Company B is doing good now. But who knows what will happen in this recession economy?! What are my options to be in legal status if I get laid-off by company B after H-1 transfer with them OR if the H-1 transfer to company B gets rejected for whatever reason?

    Thank you for your suggestions.

    (1) Do I need to leave my I-94 card in when I give them my
    old passport? Is it OK if I remove it? Do they make a big deal of this?
    A. It is OK to remove the i-94

    (2) In the online form, what do I choose for the "Service Desired" field?
    "Re-issue of passport"?
    A. Yes, if you are sending the application within one year of your old passports expiry.

    I am on an H-1B visa I had a confusion regarding my wife's case. She is on H4 visa and her H4 visa was extended to September, 2009 when I changed my employer (XXX) last year. However, her passport carries H4 visa which expires in Oct. 2007 (this was through my previous employer, YYY). Both our I-485 are pending and we both received our EAD last month. She wants to use her EAD to work in future.

    A twist is that a consultant had filed for her H-1B this April and we don't know if her H-1B came through or not. He is not telling us. We just don't want to deal with that scumbag. Can we just ignore him and forget about it? Since her I-485 is pending she has a lawful status (Pending AOS), right? Please let me know what you think.

    U.S. Citizenship and Immigration Services (USCIS) announced today that it will begin accepting H-1B petitions (http://www.h1b.biz/lawyer-attorney-1137085.html) subject to the fiscal year (FY) 2011 cap on April 1, 2010. Cases will be considered accepted on the date that USCIS takes possession of a properly filed petition with the correct fee; not the date that the petition is postmarked.

    The fiscal year cap (numerical limitation on H-1B petitions (http://www.h1b.biz/lawyer-attorney-1137085.html)) for FY 2011 is 65,000. Additionally, the first 20,000 H-1B petitions filed on behalf of individuals who have earned a U.S. master�s degree or higher are exempt from the H-1B cap.

    USCIS will monitor the number of petitions received and will notify the public of the date on which USCIS received the necessary number of petitions to meet the H-1B cap. If needed, USCIS will randomly select the number of petitions required to reach the numerical limit from the petitions received on the final receipt date. USCIS will reject cap-subject petitions that are not selected, as well as those received after the final receipt date.

    We recommend employers to hurry up and get all the necessary documents in order to meet the April 1, 2010 deadline.

    Hi guys,

    My H1-B visa is approved lastyear (Jan 2007).and I came to US on Mar 2007.
    In my H1-B visa the DOB is wrongly entered.In my passport the DOB is correct.I havent checked this and i m in US now.When i went to Driving office to apply for my drivers license they asked me to correct the DOB in my VISA.
    Can anyone helpme out how to change correct my DOB in my H1-VISA.

    Whats the procedure to change my DOB in my Visa.

    Any help is appericiated.

    Is it permitted to enter the US on a tourist visa and while you are here, can you start working since H1B approval has been received? The reason I ask is that my some time is needed to set up an apartment, get SSN etc. and it would be easier to come a little early while H1B is being processed. Can you get the H1B stamped in the passport later in Canada? Thanks in advance!

    I'm at the annual meeting of the American Immigration Lawyers Association here in Las Vegas. More than 10, 000 lawyers gathered here in Las Vegas to learn about the most recent updates from the Government directly.

    We just finished a session with the Department of Labor. Some of the key news is that more company audits are on the way. In fact, currently there are 200 cases pending in the audit line. They promised more audits as the icert system will become a standard in filing PERM, LCA and Prevailing wage requests.

    Also H2B cases now must prevailing wage requests directly with the Chicago DOL center. There is a slight delay in processing. They are currenlty working on PWD's filed on May 8th or before. Wea ll need to be patient.

    I will keep posting more updates as the day progresses. Next I am off to the USCIS open forum. More exciting news to report soon.
