Dear Friends,
I am a derived applicant in my green card process and recently I converted to EAD status from H1B.
My sister is US citizen. I would like to know if I am eligible to file another set of green card application thru family based option that is available. I know its a long queue.
I want to know if I am eligible for this process.
If I am eligible to file, am I eligible to file EAD thru that application as well.

1) Got laid off from company A (they haven't cancelled my H1).
2) Got my H1B transferred to company B (this H1B transfer has not yet been approved). I did not work for them.
3) I did premium processing for H1B transfer for company C and got it approved. I haven't started working for them.
4) Now I have decided to work for company D. They are ready to do my H1B transfer.
Will that be a problem or do I have to go with company C? I do not have paystubs from company B and C. If I have to reenter US, will that be a problem? Please help me out.

Hi,
My company applied for my H1B extn and after 3 months the status got changed to RFE... when the company lawyers recieved the letter, they reviewed it and emailed me the text below....
"Our office just received the Request for Additional Evidence from CIS by mail. What they requested in the letter is not applicable to your case and we believe CIS issued this RFE by mistake. We will respond to CIS to clarify this issue and will keep you informed if there is any update."
I have requested my company lawyers on the specifics...
Is it even possible to get an RFE by mistake? - (may be - yes)
have you seen any such instances?

Sorry for posting this in an Immigration forum. I am just trying to get some advise from people who might have already been in this situation.
My cousin came to US on F-1 visa in Jan 2007. She has been attending grad school in NY...She got money from India to pay for her tuition for the first semester as she had no financial aid....One professor promised her aid starting Aug 2007 but that prof left the university for personal reasons so I paid her tuition/insurance for one semester ($10k)....I have also been helping her with her living expenses since she arrived in US....She only worked 1 day throughout the year and has a W-2 with $29 as earnings for 2007...
My question is, can I claim her as a dependent in my tax filing....She lives in NY and I work/live in TX.....I am planning to consult a tax professional regarding this, but I just wanted to get a heads up from you all before visiting a professional.

USCIS has not mentioned of any plans to allow filing of I-485 if priority dates are not current.

"I would like to hear your professional opinion on the following issue: I have been on F-1 visa for 7 consecutive years. I have an employer that has sponsored me as a Graphic Designer. In fact I have obtained the I-140 through him already. I recently applied for employment AOS (July 25th) with my wife (She is on F2 visa) and I'm currently waiting on the Notice Receipt. School starts on August 20th and I'm hesitant on when exactly the new Immigrant Status starts. Do I still need to enroll for classes in order to maintain my visa? I don't intend to finish school due to financial difficulties, when exactly may I drop out from school? Should I remain enrolled up until I receive the EAD and AP? My birth was regiestered under totally different first name, also DOB is off by 9 days (10th June instead of 1st June). Since the birth is registered they are not issueing non-availability cert. . What to do?
I have both parents affidavits, school leaving cert, 10th class cert, PAN card showing date/place same as that in passport. Filing a civil case in India is the option but it could take more than a year. since my PD is Sep04, my 485 could be processed within months.

I have my 140 approved and my wife is on F1. How can I proceed with filing 485? (since the dates are current). I am thinking that my wife need to be on H4 before I file for 485.
