On this case, I am getting mixed anwsers

Employer's lawyer is saying that i can continue to work since have valid I-94 and they are going to appeal. Lawyer called USCIS officers and USCIS officers confirmed this ( !!!).

Second lawyer is saying that i should stop working on denied petition.

Once you apply for appeal or motion your H1B peition status changed from 'Denied' to 'Pending' and you may continue to work for employer. - this is my guess

In fact, I am planning to get advice from murhty too...

    Any thoughts on this.

Are they supposed to tell us if we've been Naughty or Nice this year?

A group of volunteers from OneAmerica (a local pro-immigrant non-profit associated with the Reform Immigration for America Campaign) and I visited the offices of Senators Murray and Cantwell (both D-WA) in the last week. We met with their outreach directors for our county and presented them with almost 1000 signatures of Microsoft employees impacted by retrogression. We also gave them a presentation similar to the one IV gave back in 2006-2007.
They were frank with us, both senators are our allies but they are not sure if they will tackle immigration, financial reform or energy/climate change reform before the Nov. elections. However, they said they will try to keep us in the loop and give our docs to the senators. We will not let up and will keep pinging them for action.
They thanked us for showing up and providing some great personal stories to back up our petitions. They also asked us to keep in touch in case they need compelling stories to help promote all aspects of CIR.

Let's keep visiting lawmakers and help them commit to CIR this year!

My PERM for EB3 has been approved on July 2008. My I-140 is pending. 485 has not been submitted yet. I don't have EAD card either. For some reason, I have to change job.

My question is, if my current employer will not revoke my current I-140 sponsorship, even I have left company, and in case my current I-140 will be approved, can my priority date be carried over?

    Bunch of thanks!!

Make sure you get a copy of approved I-140.

I am changing my job on H1B. I have I-140 approved with present company. What documents do I need to have to keep my old priority date? I have copy of I-140 approval notice. Do I need to have copy of labor certification as well?

    You cant.

I140 is company's documents and uscis will not talk to you.

Dont worry..my EB2 at NSC took 11 months for approval.

Talk to your laywer frequently as they recive the approval notice without the website getting updated.

Mine online status still shows "case received and pending..." when i got the copy of approval notice from lawyer in Nov.

    Thanks

Immigration Visa Attorney Blog Has Just Posted the Following:
When the Senate advanced the job-creation bill last week, employers were given the signal that hiring tax incentives are on the horizon. Perhaps in a nod to the Administration's No. 1 priority of creating jobs for unemployed Americans, the USCIS has just announced a forum on the EB-5 immigrant investor program. In the last year, and as recently as December 2009 (http://www.uscis.gov/portal/site/uscis/menuitem.eb1d4c2a3e5b9ac89243c6a7543f6d1a/?vgnextoid=facb83453d4a3210VgnVCM100000b92ca60aRCR D&vgnextchannel=facb83453d4a3210VgnVCM100000b92ca60a RCRD), the USCIS issued updated guidance on I-526 and I-829 filings (http://www.uscis.gov/files/nativedocuments/eb5_17jun09.pdf) so that USCIS adjudications could make decisions with clarity and consistency, allowing investors to make job creation through the EB-5 program a reality soon as possible. These are all indications that this is the time for foreign investors to again bring private enterprise to our great nation.

The upcoming USCIS EB-5 forum is only open to attorneys representing these so-called "million dollar investors." Fong & Chun attorneys will be in attendance and ready to present concerns facing our clients as well as potential issues for those investors considering the EB-5 program.

It is true that the EB-5 investors greencard process is often called "hypertechnical," and has in the past been plagued by administrative delay and inconsistent treatment. But I believe that the view of recent USCIS' actions, the agency is acknowledging just how critical the EB-5 investors program is to our nation's economic recovery. For each EB-5 investment, 10 full-time jobs must be created, and that means 10 more working Americans. Call Fong & Chun, LLP if you would like to discuss how you can start investing in America. ---ecf

First, your friends father needs to find an employer who is willing to sponsor him for H1B and later for GC. Usually, all legitimate employers will have a host of immigration lawyers and counselors who will take care of things from that time onwards.

That said - now may not be the best time to try and find a job in US. Finding a H1B job (i.e. one that cant be filled locally) - is even more of a challange. I wish him best of luck.

If the person has relatives in US (is your "friend" a US citizen?) - then he may be able to "quickly" (1/2 years for immidiate relative, much more for others) immigrate using the family based immigration.

I got hold of a copy of the actual RFE and when I read closely, the above statement sounded alarming. Since the labor was filed in 2003, I was wondering what relevance June 26, 2006 has.

    Any help is appreciated.

While responding to RFE add this information. Ask them note that your priority date is August 2003 and you have two years of experience prior to that date.

Has anyone considered: In Arizona, what's going to happen to all of the immigrants who are there perfectly legally and are actually creating American jobs via the EB5 green card program? Will the be harassed? I say probably.

    could this be true?

Repubs are the only one from whom we can expect support for legals.

Dems didn't do sh%$ in first two years when they had majority in all chambers and now they are trying to make repubs look bad.

Search the forum...This question is answered.

    Hey guys,

I work in a MNC, my I-140 was filed on July 16th 2007 and is still pending and they r filing my I-485 and my wife's I-485 (as dependant).

But now I came to know about my wife's labor application has been approved and they want to file my wife's I-140 and I-485 concurrently, so can I file another I-485 through my wife's employer for my wife as primary and me being dependant to my wife.

I know this question must be asked a lot of times but does anybody has done it or not done it, please share your experiences.

    Thanks in advance.

You can take time off -- like 4 weeks without any issue (I have done this), as long as the new company has filed to transfer your H1B petition.

I guess you should avoid going out of status -- where the old company has revoked your H1B when the new company hasn't even filed the H1B transfer petition. Other than this, taking time off between jobs should not be any problem at all, provided you stay within the country and, no travel outside the US. But if you do, you should consult your lawyer about its implications. Good luck with your new endeavors.
    Sri.

    Thanks
