Back in 1986, Immigration Judges denied almost 90% of all asylum requests. Now, during the past 9 months, the Judges granted 50% of asylum requests. What's more, the disparities among various Immigration Judges have narrowed somewhat. I received my approval documents yesterday and today I noticed that my name is different from that displayed on my passport and previous H-1B approval.
I have a two-part last name and only the first part is displayed. Will this become an issue? The attorney tried to brush it off and said that the name was the same as the one on the petition (which of course he filled, so I don't know why he used this as an excuse).
I'd like to know if I need to do something about it. I don't want to have problems when exciting the country.
Any advice will be appreciated.

In addition to contacting the law makers, we should be contacting the media to highlight our plight. I just read on IP that the media is unaware of the BEC mess (http://www.immigrationportal.com/showpost.php?p=1406956&postcount=3019) and would be interested in taking it up. Hi,
My I-140 was filed at VSC on 7/7/07. It was later transferred to TSC.
In this case, would I base my I-140 processing time on VSC which is stucked at 04/01/2006 or TSC which is at 08/15/2007?
I was hoping the later but I just called USCIS customer service and they said that A) it is based on WHERE YOU INITIALLY FILED and B) my application will eventually be sent back to VSC. I appreciate if someone can verify this. Thanks.

Just need some suggestion:
I may be on the chopping block next week..
currently am on my 8th year H1, expires march 2010..so less than a year to restart..and be back in the line. (spouse on H1)
My 140 is pending...
so if i lose my job.. can i go to H4.. even though i have stayed here for more than 6 years..
and in case if i get job ...can i get back on H1 and restart GC?
i am thinking.. i have come to the end of all options.. and the only course available for me is back to desh..any inputs..will be appretiated..

Hi,
I have applied for H1B extension for 3 years based on my I 140 approval. I have submitted all relevant documentation except for client letter.
My current H1 expires in Oct and we are expecting our baby in October as well. I would like to know what would be my options in case my H1 extension in denied. I cannot leave with the new born atleast untill december (need time to get passport n visa for the baby) and I wouldn't want to get into any legal issues like staying in US n not being in status.
Looking forward to your advice and suggestions

No. You can file two I-140 petitions from the same employer and your approved H-1B for three years is not in trouble. I don't blame you for your deepest concern in this issue, as USCIS made each and everyone of us so concerned about our every walk of our life.

I've had my I-140, I-485 pending since August 2007 in Nebraska and i just started getting worried recently when i found out that the job title in the I-140 does not match the job name in my labor cert.
My labor cert took 4 years to be approved and in the meantime my job changed. It is still in the same field/department, in the same company, but it just evolved but still requires the same skills as the labor cert.
I was originally on H-1B and now i work with my EAD. My H1B was amended when my job changed but not the labor cert since we were well into the process when all this happened.
This is really the only concern that i have regarding the approval of my I-140 and I-485. Do any of you know if the job name difference would be a problem for the I-140 to be approved? At the least i hope they would send me an RFE and not deny it right away.
Thanks for any advice you could give me!

Can anyone suggest if there is a way to check the priority date on a I-485 application after an interfile request has been made? I am not sure if a call to the Service Center is the only way, or if there is a form I can submit requesting this information.
The context of my question is this: My original I-485 application was filed based on a LC/I-140 approved by PERM with PD May 2005. But later, as part of backlog elimination, an older LC for me with PD Aug 2004 was cleared and my company's immigration law firm got another I-140 approved based on this earlier LC. They've told me that they contacted USCIS with a request to get my I-485 attached to the older PD. I would like to get this confirmed since a 9 month gap in PDs can easily translate to years more of waiting time.
Thanks in advance to anyone that can help out or suggest if I should be doing anything different with getting the PD of my I-485 changed.

Patrick will support proposals in an advisory report calling for more English classes for the state�s immigrants and in-state tuition for undocumented college students. Have you tried calling their office? From what you say, it been more than a month! Call the TX center and if their answer does not satisfy you, lodge an official complaint with the ombudsman's office.

While taking a VISA appointment , there is a question which says "Are you applying for same visa class that expired in the last 12 months?"
Here are my doubts
1. I had a H1 B VISA which expired in May 2007 processed by my previous employer. As I am applying for the same VISA class , but though a differnt employer, should the answer be 'YES'?
2. Since my daughter will be appearing for the H4 VISA interview for the FIRST TIME, Is she also eligible to come along with me if I choose "YES" to the question "Are you applying for same visa class that expired in the last 12 months?".
