I have an approved I-140 and my 3-year H1-B extension is currently being processed but not in premium and has not been approved yet.
I have decided to leave the job/country and want to know if there were any consequences of leaving without the approval (current I-94 has a July 2010 expiration date). I am still working and technically in status as it is in process but the approval could take a few more months. Should I push for premium? Any advice? I would hate to have any problems with getting future visas to the US, either tourist or getting back on an H1-B.

After seeing the State of The Union Speech I wrote to the President about green card processing delays and immigration reform.
I would recommend you all do the same.

my wife is US citizen , applied for permanent residency (green card) almost 6 months back , my interview was 2 days back, everything went thru alrite, the immigration officer said at the end of interview , " your case been aproved, but we did not get the background chk from FBI , as soon as we get it we are going to mail you the green card "
is this normal? i checked "case status' on USCIS website, they still have some update from 4 months back ...

I have a friend who is stuck in background check for 2+ years (same situation, a spouse of a US citizen). Hope it won't happen to you! Not much you can do now, just wait. If you do not get any response within a year, consider suing the USCIS (that's what my friend is doing).

as well as I see a separate bill for foreign nurses is coming up for discussion, we I feel we should talk to our lawmakers to bail us out of the EB-3/EB-2 India/china mess
The employer lobby is always desperate for a Nurse Green Card just because they cant be hired on H1B. Sometimes I wonder perhaps things would have been better if H1B had not been there for IT folks...then the employer lobby would have genuinely lobbied for
GC reform.

Look at the top table which shows data released by DOS. Last month 75 application have been reduced and in month back 100 applications were reduced.
This is really really bad sign for EB3 and even for EB2.

Mine was in CSC. Premium filed on 15th June 2007, got approval on 25th June. I have not received a receipt, but got approval :)

Can some one please shed some light on this May 15, 2005 cut off date and its significance ? Does it affect folks who have already filed for labor and I-140 after this date and have got it approved .... say sometime in 2006 ?

hi,
They should file form I-130 for you immediately and once your priority date becomes current, you could file 485. You need to maintain status until you file 485. You should not wait until they become U.S. Citizens. You should lock your priority date and it will carry over even if they are U.S. Citizens. Family immigration is on a much faster track now.Take a look at past few visa bulletins to see.

According to new regulations only jobs on Job Zone Five can apply for EB2???
If this is true only 15-1011.00 - Computer and Information Scientists, Research can apply under EB2 category for ITJobs.

Hi,
I am a dependent of my parents who are currently staying in the U.S. with E-2 Visa. We have stayed in the U.S. for almost 9 years now and we are trying to get a Green Card.
My parents have already filed and received an approved I-140, but my parents say that we have to wait couple years before being able to file I-485.
I don't quite understand why there is a delay between receiving an approved I-140 and filing I-485.
It seems like everybody either files both I-140 and I-485 concurrently or file I-485 immediately after I-140 is approved.
So, my question is: Is there usually a span of time that applicants must wait before filing I-485 after getting their I-140 approved?

Since the h1b quota for year 2009 is not exhausted, can one(company) file the h1b visa right away or do we need to wait for April 2010?
One of my friends is interested in coming to the US. The consulting company to whom he applied said that they could only apply for the H1B visa in April 2010.
