I had submitted I-131 document along with I-485 & 765 on 8/1 and received the receipt notices already from TSC.

I had received my EAD card on 10/10 and Biometrics is scheduled on 11/13.

I have booked my travel tickets for treveling to India on 01/04/2008.

What should I do now, to get AP (I-131) approved?

If you are filed in EB2, you can file I-485 and I-140 concurent after getting the PERM approval using cross charge. (EB2 ROW is always current). If you are in EB3, you need to wait 3-4 years to file I-485. (Long wait).

My wife is on H4 and is planning to convert to F1 before joining graduate school to get scholarship. At same time my PERM is filed and once approved i was planning to use cross chargebility to file under my wife country of birth quota (UAE). i wanted to know following

a) if she applied for conversion for F1 today, can she get scholarship before she gets ssn or she has to wait till she gets ssn

B) If during her F1 processing time or grauate studies on F1, if my PERM gets approved, can i file for I-140 and I485 using cross chargebility with her being on F1 or i would have to wait for her to conert to H4? If there any risk to our green card processing

C)If she continues on H4 visa, can she still get scholarship? if not once she graduates would she be in special US master degree quota for H1B?

Any help on these would be great

If you read the rules closely, the employer is attesting to the fact that the job will be readily available at a future date. So as long as the employer issues a letter attesting to this, there is no issue. AC21 is very specific = 180 days not less. So even with a letter from the employer, IF i-485 has not been pending 180 days, you cannot induce AC21 If you do indeed move prior to the six months, make sure you amend your H1B for the necessary changes (eg location)

Confirm with the co lawyer also. Yes, you are right. Always confirm advice with a lawyer

My H1B visa may be getting expired Sep4th....but her old H4 approval is valid until 2011.
Is she safe even my visa (H1B) expired on 4th Sept.
If I apply F1 (Student Visa) now...it will take another 45 days to get F1 approval from INS.
So....what happens to her status? Is she valid to stay until she gets F1 approval notice?

I would think writing back to the Senator's office regarding your email and the unrelated response you got from the office has frustrated you, as the Senators does not seem to understand the problems, and therefore you are asking for an appointment to meet with the senator and explaining it personally.

You may not get the appointment to meet with the Senator, but you will let them know how badly they are screwing up constituents complaints. By following up and actually meeting with an immigration staff members in the Senator's office will be good.

I have an appointment for H1 VISA re-stamping in Toronto, Canada in 2nd week of October

My current H1 VISA is valid until Nov 2006.

I am planning to get restmped based on my new H1 petition valid until Sep 2008.

The problem here is that my passport is valid only until Dec 2007.

In this case Can I get the new VISA stamped until Sep 2008?
On the website it says that "To be eligible for a VISA, you passport must be valid for at least 6 months past intended stay in the United States"

Please post your valuable replies.

Yes you should get the Visa till 2008 - once passport is near expiry - get it renewed from indian consulate and later tag both passports together.

My PD is Feb 2002, EB2 and 485 ND: 06/15/2007

I renewed my EAD last month believing that it may trigger GC approval.
Today i received my EAD renewal for 2 years. Expiry date is July 25, 2010

Having oldest PD and receiving 2 yrs EAD, is it a good sign or bad? Please let me know.

The vermont service center says 2 months for h1b extensions, mine has been pending for 75 days, so i called the uscis today and guess what they told me, the processing times have been updated on teh web site but it is very difficult for us to follow them, i would suggest you wait for 90 days and see if there is any change in your online status if not call me back.

Then why do these people keep updating monthly processing dates if they cannot stick to their words.

I believe the processing times are just a gimmick to show progress to press....:mad:

Guess what, CIS @ NSC, TSC looks like never want to cross even the processing dates beyond July 2007. I will be not surprised if they do not cross July 2007 for another year.

Pathetic - Back in India (and the Indian Consulates here in the US) - they play with our paper-work - right from when I remember - it's been one story after another...it's really frustrating.

By the time we finally get our GCs', the drive, focus and amibition - all of it will be gone...

Can some one reply my following questions about Advance parole

Hi

I am trying to file Paper based Advance Parole ( I-131) for me and my family.

I have few questions regarding process and forms. Appriciate your hlep with those.

(1) I Last enetered as F-1. My F-1 visa stamp has expired. I currently have H-1B approved but never stamped on my passport. My I-140 approved and I-485 pending.

On form I-131 in section 3. "Class of admission" what I should write " F-1 "or "H-1B"?

(2) If I check on "More than One trip" in Part-7 section -1 of the form, does the process differ in any way? Does it need any extra fee? Does it need any extra document to support the multiple entry AP application? Will it affect approval in any way? How long (one yr two year?) is AP, once it is approved, is valid?

(3) I never had applied for EAD based on pending I-485 and does not intend to do so in near future.

Does I need to apply for EAD to get AP? and in Cover letter for my AP do I need to mention EAD or it is not required?

(4) For my sons ( 15 yrs age) can I sign as a person preparing form?

(5) Where can we get appropriat photos for I-131. I went to Wallgreen and CVS but both told they all have digital photographs only. Also they also dont take side view they all take frontal view? so where can we get approriate photos for I-131 (Advance Parole)
