    Mine was filed in NSC on July 24th, I140/485 only got transfered to TSC on Sept 14th, Got EAD from CSC on Sept 21, AP from CSC on Sept 25, FP notice on Sept 29th for october 16th.

    My friend - the list provided the consulate is a list that is now being asked after thoughtful deliberations. Consulates do not fall easy prey to petty politics of local (US) congressmen or Senators.

    They have not mentioned that if you dont have any-one of these documents you cannot apply for an interview. If the petitioner is good enough employer there is not harm in going w/o one-2 docs missing and a explanation letter of why its not there.

    If the employer has tax filing for previous years, employee list and wage report to proove that employer has paid IN FULL and IN TIME to all employees irrespective of whether they were on bench or on assignment then there is nothing to fear......

    If you have been in similar situation (not being paid on bench...or employer is exploiting you) its your personal problem. Dont say that there is no mis-use and govt should not plug the hole if it has not done it in the past.

    hello friends...please be noted that the duration of employment with the company is not mentioned in the clause. Please read it carefully... its says that WHENEVER you leave the company, you will have to pay any training costs that you have availed in previous 12 months.

    So tis means that if I decide to leave the company after 3 yrs of employment with them then also this clause is applicable to me.

    Please advise me....should I sign this contract or not?

    Hi all,

    Now H1 period no longer counts against H4 period. As H4 is allowed to do volunteer I work, I had taken up few Volunteer Projects and done some Open Source Projects for keeping my Skills updated.

    Is it advisable to put all these expeience in resume, while applying for a new H1B or only professional experience should be shown on the resume.

    Advice please.

    Slight clarification to the new regulations:

    Based on the "If they return from the USA after having used the visa" exemption, you don't need a transit visa for the USA-Germany-India leg. But for the return you'll either need an AP+transit visa OR a valid USA visa.

    This exemption (and regulation) is the same as that for France. And I just traveled to India and back (in Dec2010) through Paris on expired USA visa and therefore know the above to be true (at least for France).

    Drivers license is not meant to be used as an identity document. US has screwed that logic anyways. One of the security issues is this country uses drivers license as an identity document.

    Even if it has to be used for identity purpose, an identity document says this document represents the person holding it and his identity has been verified. Immigration status or job verification has nothing to do with identity.

    How does employment verification serve the security needs ? If so, are citizens guaranteed not to do anything against the security of the country ? I don't think so.

    Are employers the ones who vouch for security credentials of an individual ?

    This is what I don't understand. The original discussion was that getting an EVL is a bother. Now are you saying there should be another document people would need to apply for as proof of identity? Wouldn't that be an even greater bother?

    Now, since the drivers license is used as proof of identity, it is necessary to ensure that criminal elements do not get it. Which includes illegal / out of status immigrants who could also be a security risk. Employment verification ensures that the person holding the H1 or H4 visa is in valid immigrant status. Which is why they ask you for the EVL even while stamping the visa. That is the security angle. Seriously...this is all fairly obvious stuff. The govt just wants to make it difficult for illegal / out of status aliens to get a drivers license. What is wrong with that? The funniest comment on this forum from somebody who was ruing that he couldn't bribe someone here for a license like he could do in India. Really? Do you want people driving on US roads who bribed their way to a license?

    Hi ,
    I sent i140 papers and money in feb 2007 to my company. in april i went to india and came back in May. in May when i asked the recieved number of i 140 filing to my company then they told me to wait for 2 week and after 2 week when they gave me recpt number, i checked online i saw following message.

    "
    Current Status: Case received and pending.

    On May 16, 2007, we received this I140 IMMIGRANT PETITION FOR ALIEN WORKER, and mailed you a notice describing how we will process your case. ..................
    "

    looks like my company sent paper to USCIS in may not in march or april. is that currect? is the USCIS receipt date is the i140 filing date and gc cut off date if CIR bill passes? please throw some light on this.
