The border guards do this, even when they do not really think someone is lying. They do it to destabilize or disturb the alien, to get the alien to make an error or say something wrong. Basically, it is a trap.
Recently, Alan Bersin (http://en.wikipedia.org/wiki/Alan_Bersin), the commissioner of US Customs and Border Protection (http://www.cbp.gov/) -- the head of all the border guards -- told Congress (http://www.google.com/hostednews/ap/article/ALeqM5j07I9Bw4Q1kxusXReW4qAjNPdR2AD9FM4S300) that he did not know he was required to fill out and keep Federal paperwork to verify that his household employees had the right to work in the USA.
Bersin is the head of US Customs and Border Protection.
Bersin is a former California Secretary of Education.
Bersin is a former US Attorney.
Bersin went to Harvard and Yale.
Bersin says he had no idea he had to follow the law?
Why is he lying to us?

Jan'09 : My Employer submitted 7th year H1B extension - Vacation Recapture + Extension based on pending I-140
Feb'09 : RFE was issued asking information related to Company
Feb'09 : H1B - 6 Years completed : H1B Visa / I-94 Expired in Passport
Mar'09 : RFE responded with the requested information
Apr 10, 2009 : USCIS Denied H1B Extension petition.
I understand from my employer that I can no longer be on the US payrolls and that I've to leave the country in 180 days.
Is Motion to Reopen (MTR) / Appeal is an option to legally stay in US ? If MTR is submitted, can I continue to work for the employer / client and get paid ?
Appreciate your inputs in this area.

Hello guys,
I came to US to pursue masters, and have started working on H1b while working on my thesis in parallel. Meanwhile my advisor did not get his tenure approved, and had to leave the university. So I had to abandon my thesis work, and had to register for extra courses. My employer and the client I work for are okay to let me go to university for 2 months, but my employer did not pay me for the period (no paystubs for this period). So my year-end wages fell short of the LCA amount.
I know that unpaid leave is not legal while on bench, but since I took the leave while I was actually on a project, does anybody think mine is a genuine case, if there is any such thing??
I am looking to go for stamping, and is really urgent

Received my REF last month then i sent my reply and they received it. Now everytime i checked the online status the Update Date in the online account is changing everyday for last couple of days. What does it mean? Is it a positive sign or not? kinda worried about the whole situation. Please let me know what you guys think or anyone get this kind of update or not?
Current Status: Response to request for evidence received, and case processing has resumed.
On month xx, xxxx, we received your response to our request for evidence. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service. I do not think being on h1b on only 6 month would be an issue. if he is going to take care of all expenses of their visit, he would have show enough saving + salary to support them.

My friend's on her 6th year H1B and it will expire on Sept 10, 2010. A PERM labor was filed and the Labor went into an audit, responses were sent immediately.
If she transfer her H1B to new company.
1. Can she ask for 1 year extension based on her pending labor? Does she need to wait till the labor gets approved?
She can get one year if the LC is pending for 365 days, as previous poster said. However, the new company needs to be able to file a new PERM immediately, so she can get an 8th year extension. It is very unlikely that the old company will keep the permanent residence process going once she changes jobs.
2. Can she use Premium Processing for H1 transfer?
Yes, but if she's maintaining status she can change employers on filing the new H-1B. The company doesn't need the expense of PP.

My 140 was approved in september (EB2; IN) and i belong to july 2 VB fiasco.
i was just checking my case status online and i noticed that my LUD for 140 (which has been approved) was changed to december 2007.
what does that mean?? i hope its not an RFE or rejection after approval just like some other people on the forum.
Can anyone please help me out.

Great tip from AILA for our H1B (http://www.h1b.biz/lawyer-attorney-1137085.html) filers trying to beat the rush. Because you cannot submit an LCA earlier than six months prior to the beginning date of the period of intended employment (20 CFR � 655.730(b)), if you want your LCA in hand before April 1, then set your employment start date on the LCA for a date in September, and set the expiration date for a date no more than three years hence. File the I-129 with a start date of October 1, but with an expiration date that coincides with the expiration date of the LCA. You will lose a couple of days on the back end of the petition by doing this, but you will get the LCA filed and back before April 1.
Example:
LCA start date: 9/1/10
LCA end date: 8/31/13
Form I-129 start date: 10/1/10
Form I-129 end date: 8/31/13
Due to delays in receiving approved LCAs, take the proper precautions and file your LCA early to avoid any undue delays.
Although under certain circumstances USCIS has agreed to accept H-1B petitions for processing that include LCAs that have not been certified, attorneys should understand that if the LCA submitted with the H-1B petition is eventually denied, the H-1B (http://www.h1b.biz/lawyer-attorney-1137085.html) will be denied, even if a subsequent certified LCA is submitted. This is even true where the denial is due to DOL error in not being able to verify a petitioner's FEIN. However, USCIS has also indicated that if the sole reason for failing to apply for an Extension of Status or Change of Status is due to DOL delay in the certification process, USCIS may look at the totality of the circumstances in determining whether to accept the late filing.
Bottom line is that getting an approved LCA before April 1, 2010 is crucial. Pay attention to detail and get the files ready in advance is a must.

One of my H1B friends went to Frankfurt for some work and expired US visa...The Germans gave him visa because the client is a very large bank in Germany..
I remember that to get the H1B restamped he went to Delhi after he was done in Frankfurt...
If your client in France is big enough and gives you a letter....most likely French would give you visa....They would ask for detailed itenerary...

My H1b was approved in feb 2010 for location A.Before I could start working at location A,my company found a better client (close to home,better pay) at location B .(different state).
what should my company do or have done with regards to lca for me to work at location b.
should lca have been approved before I moved to location b or could it be filed after i started working at location b. If lca was filed after I started working, is that ok.If not, how do we correct this.

Did anyone get their 140 approved from Vermont?
My 140 and 485 were filed late July 07 in Nebrasks and I got notices stating the 485 was transferred to Texas and 140 was being processed in Vermont.
The Vermont processing time for 140s has been stagnant at April 2006 for a long time.
Wondering if anyone has any updates on this.

I don't know about any of those lenses from personal experience, but for what it's worth, Bj�rn R�rslett rates the f/4 version at 2.5 out of 5 (on a D1x, which is similar in resolution to the D70), and doesn't have much praise for its image quality. I'd guess that the f/4-5.6 versions, being newer designs, should be better.
