so far i've been the ones to pay everything...i know govt got stricter this year and now it HAS to be employer who pays....so i'm in bad place as I know how my employer is...

yes i had receipt number for 140 but employer was not giving me 140 approval notice and labor certificate approval copy.

On your I-485 approval, H4 status is lost and no longer valid.
Incorrect!
If the person is out of country while on H1/H4 and I-485 is approved, he/she can enter USA on valid H1/H4 visa stamp and will be offered Deferred Inspection. In most cases, they have to report within 7-14 days to local USCIS for passport stamping.
I suggest that you get more details about Deferred Inspection with your attorney.

Can't avoid anything that future hold for you.
1. It would be good if the employer does not let USCIS know about your layoff.
2. don't apply for unemployment benifits even if you are given one (at least for 180 days from I-140 approval).
3. Hoping your employer does not revoke your I-140
4. Take a 3 months unpaid vacation at the same job and/or offer help by working from home. Accept a lower salary for 180 days.

I like to know your experience with Perm for job zone V and ad in paper.
Which one you think will go through easier without the audit.
Our company attorney says master+0 will work. But I am thinking to require some experience will get better chance. I have master with 2 years before joining this company.

yes! thats what ac21 is for...
in my case, i talked to a lawyer before i did ac21. i will also talk to lawyer again if i change jobs again.

Now got rolled out from project and no paycheck form since june 2009
and Now found a project but the vendor wont do corp-to-corp..but only W2...
THIS CASE CAN I JOIN WITH this Vendor ON W2 With out applying for one more AC21??

I have never been to the meeting but will like to attend one if scheduled in future. i think its high time our Chapter schedule meeting with Senators/Congressmen in this area including MD, VA and DC. The President has started the immigration reform initiative and it is right time to make the lawmakers aware of our EB issues. Let me know your thoughts.

I have applied for my H1 extension in July 2010 and still waiting for the approval. My in-laws are visiting the US in dec and i am sponsoring their visit. Should my H1B be approved before they appear for the Visa interview or should the H1 receipt notice be enough? Please let me know.

If it is not too urgent wait till your H1B is approved. If it is urgent just write a letter stating the facts accompanied by a copy of your old H1b, new H1B receipt notice and a letter of continued employment from your employer. Yes include other documents like paystubs, past tax returns and etc.

You can file uptill Sep30 2010, or when the quoto gets over, whatever happens first.
And as far as your start date is concerned, if your H1B is from the 2009-2010 quota and you've applied for it after oct 2009, it can start anytime after Oct2009 till Sep2010 ( the date your H1B gets approved), please get this confirmed though.

Hi,
I was on H1 before and my I797 form says my h1 is good till 082011. And in June my employer terminated my employment. Within a month I changed my status to H4 and got my H4 visa stamped from India. Now I got a project and my employer re hired me and started my h1 processing (regular). And my client gave the start date from Dec 14th.
My employer is saying that you can work from Dec 14th however once you get an approval you have to leave and comeback with H1 stamp on it.
They said that we have done these situations before and I also contacted one of the person and she was saying that she started working once h1 filed then she immediately left to India to get stamped (She also said they is an option to get it stamped in Canada as well).
Now is this true? My GC process currently waiting for the date (EB2-I140 APPROVED). Does this affect my GC in future?
I told my employer( it's a big reputed company) and they are saying that we will ever do anything illegal, if it is illegal then we won't even consider that option so you are fine don't worry and our immigration lawyers are very experienced so you have understand and trust us. This is what they are saying.
Whom to believe? What is right? what is wrong? Please understand my confused situation. I am going through lot of stress right now because of this.

I think it goes around intent. Does your sister show signs of staying in the US or does she fully intend to return. Proof of reasons for her to return would be good to have on hand.

My LC was approved recently(PD June 2004). The location/office for which my LC was initially filed was closed recently.
My company(which has offices all over states) has another locations/Offices in the same metropolitan area.The company attorney is saying that they can use my approved LC to file my I-140(and I-485 concurrently) for another location in the same area as long as it is within commuting distance of the original location.
Was wondering if anyone knows about this?

The wages for Labor Certifications are determined by MSA(Metropolitan Statistical Area), so as long as the new location is in the same MSA, there should be no problem.
