    You can extend apply for AP (Advance Parole) ;-) at anytime provided you have your 485 pending so there should be no "risks"

    only risk i see is that what if you have to travel and for some reason your H1 stamping gets delayed (if you have a AP you will be safe there)

    Also their processing times keep on fluctuating - what if you later down the road are
    in need of AP apply for one and then dont get it approved by the time you want to travel

    Personally I prefer to just keep things simple and apply for AP renewals even though
    I wont use them - just so that there is no "divergence" from the norm
    Just so when USCIS officer is processing your case they wont have to think or
    issue query to get clarification etc etc

    Some more information on this....I just spoke to another CSR @ NSC and asked her about Extended review....she mentioned that it is a normal process and that they have various agencies involved and that they r waiting for response ...did'nt mention what the agencies are or what is it that they r waiting on....also I asked her if I should take and INFOPASS appointment to find out more....she said that would'nt be of any help cause they will also not be willing to tell me more.....

    She said wait for about 90 days and if you still don't here from us ..give us a call and we can then take it from there....

    I guess I am going to stop worrying and expecting any results soon...lets just wait and see....

    I am in the exact same situation. I have already filed I-140/I-485 concurrently with the substituted labor. Now the dates are current I am filling another I-485 with my approved I-140. There is nothing wrong in what we are doing, as long we explain about the earlier filling and clarify the motive of the second filling. Eventually we should withdraw one of the two based on the outcome of substituted labor/I-140.

    I am currently working as a Functional Solution Architect in an IT firm.

    Current Status: H1B (6th year)

    GC status as follows:

    Priority Date: April 2007
    EAD received: October 2007
    I-140 is approved.

    Under the AC21 portability I believe I can change my employer without affecting my GC process. However I want to change my field of work from IT to Finance. My question is:

    1. Is that permissible and can I use my EAD to work for a new employer in a different field.
    2. If the above is not permissible and If I change my job in the same field, can my previous employer cancel my GC process, even though my I-140 is approved. If they can, how can I mitigate that possibility.

    I am currently on an H1-B (and also have a I140 approved) with company A. I accepted a job with company B, who started the process for my H1-B transfer by filing the LCA.

    My employment with company A ends 01/31, but company B has still not received the LCA approval. If they do not receive it before 01/31, will I be out of status until they file the H1B transfer? Do I need to leave the country?:confused:

    Technically, yes you will be out of status starting 02/01 until H1B petition from your new employer is received by USCIS. Yes you should leave the country as from Feb 1 you will start accumulating unauthorized presence which might adversely impact your Green Card and other future petitions including the pending H1-B.

    Practically if H1-B is filed within a week or so after 1/31 then it is up to you if you'll like to take a chance by staying in the country.

    Hi

    I am going to apply for i-485,
    i have birth certificate which is taken in 2005 but I was born in 1974
    some of my friends are saying...as you are born in 1974 and as your
    birth certificate was taken in yr 2005, it might cause problems (ins poseses query)
    to get the green card.
    Is it right?
    They are saying me to get Affidivits + non availability certificate now.
    will it be a problem if I put my birth certificate....while applying for 485

    My advise is to get a Non-availability of birth certificate because an RFE is the last thing you wanna see. My wife tried Allied Legal, India to get Non-availability of birth certificate for her parents. you can try them. They are the immigration attorneys in USA.     I signed up with a new Attorney for filing my 485. I sent my documents in the last week of July and until I sent my documents out, she was communicating well saying she will make sure everything is done in time ...... and assured me that her clients are her strength .....

    She has not completed the paperwork till now and she closed down all communication channels with me.

    On Friday the paralegal called me and told me papers are getting ready soon.

    I am confused and don't know how to deal with this situation - I figure out that it is too late to trust any lawyer now.

    Though there is no point in submitting on July 2nd anymore, I am just wondering what must be the next course of action?

    I am sure they will drag this through end of next week because they seem to cater to corporate clients rather than personal clients and are very unresponsive.

    In general - what are folks doing, especially those who did not file yet? Are all your packets with lawyer, ready to file and send?

    My case is like this....

    Actually I got approval notice of H1 transfer case in month of Nov 2009 for which my current employer initiated in month of Aug 2008.

    During transfer case in pending status, I got an RFE in April 2009 for which my employer submitted concerned document...later I did not have any updates of my case until Aug 2009 when employer called me and told about an second RFE which was about client letter...I lost my running project job becoz of that. but my employer again submitted client letter from somewhere which I dont know.....I thought now everything is good..but I did not get approval update from USCIS/employer after that also......
    After 3 months when I check case updtate on USCIS portal then I found that my case is reopened and approved. Later when I get project and asked for salary increment to employer then he told me that there is no second RFE actually he received denial notice. I was shocked and asked him why did not he tell me about that as he has not given me any RFE related document of my case so I have to belive on his words.

    Now my queries with different scenarios is as follow
    Q1)If I file WH4 against him for those bench
    period without any newly initiated transfer (petition belongs to that employer only)...will there be any problem for me as that period was out of status (as said by my employer)?

    Q2)also will it affect if I newly initiate transfer process to another employer which is suppose in pending status ?

    Q3)If I have approved petition of newly initiated transfer(of another employer) but WH4 case gets denied. will it affect my approved petition?

    Q4) if both H1B transfer to new employer and WH4 case against previous employer is in pending status ...and WH4 gets denied will it affect my pending transfer case?

    Q5) Is it really good to file WH4 case against previous employer as soon as I start another transfer? what will be your opinion whether to file WH4 case before new H1 transfer or after when received RFE on pending new H1 Transfer case.

    Appreciate if any attorney can help me in this situatation.....

    Any idea how long it takes to get 485 approved. I applied on EB1. My I-140 was approved in Jan07. Any idea about FBI check I mean Background check,Name check and other checks.....how much time it takes....
    And in case if it stck where it could be and how to check the status of that stuck??????????????/

    I am worried about my employer. Given the fact about I-485 apps and the last few days of labor in the previous month I have doubts about my employer. He is a very mean and hopeless desi employer and I am worried if he sold out my labor to some high bidder. is there any way i can find out if my labor is still infact in my name. any thoughts

    I have I-140 approved and also based on I-140, I have 3 years H1B approved which expires in 2010.
    My I-485 was rejected and I have re-submitted which is obviously pending and not further news on that (refiled on 10/10/07 at CSC)

    I have following questions:

    1. If I want to travel to INDIA for 6-8 weeks, Is there any problem?
    2. Can I get H1B VSIA stampled at BOMBAY?
    3. Do I need any other document except H1B approval notice & I-140 approval notice?
    4. Do I need to mention about I-485 been filed?

    Please help. Thank you in advance.
