I was double minded to do porting or not. Now I am considering it very seriously. Got a green signal from my current EMPLOYER to go ahead for EB2.
Is it possible to change category to EB2 with same employer/same job?

My receipt date is June 20 and my PD is Oct 2002. If the July visa bulletin does retrogress, will I still be affected with regards to I-765?
No you will still get AP and EAD since you have receipt date. You may not get GC approved until the dates become current. Experts correct me if i am wrong

My lawyer said u cannot have 2 485 petitions with USCIS.
My Lawyer's response - You should be aware that you cannot file two I-485 applications. If you file individually, there is no option to file as a dependent UNLESS the pending I-485 is withdrawn.
Awaiting reponse from my wifes lawyer.

Correct me if there is a misunderstanding due to culture differences.
The flowers are by no means a complement. They pass them to other people and basically, they are forwarding the shame to them as well. Whoever receives it would feel offended. Don't you think so? :rolleyes:
If this is not the paramount of their stupidity, I do not know what else is. Oh wait, it is USCIS... who knows what other crazy thing they may do. :D
This is just getting better and better... Make sure get a screen print for future reference. Maybe a message should be attached to the flower too so that no matter who receive it, they will know who and what that is for. :D

If I am not wrong VDLRAO is predicting Eb2 will be current with in a year if USCIS continue horizontal spillover. What is wrong with you..

Happy for those who go the receipts notice.
Mine was signed by J. Barrett on July 2nd @ 10:25 AM and got no update so far.
Tried calling USCIS they don't answer properly.
Lawyers saying can't do anything but wait and watch.
Any idea after 90 days if it's still not in their system then what to do

I talked to my immigration about this today. My wife is on h4 and her h1-b is not selected in this year lottery process. I wanted her to go a school which issues CPT in less than one year so that she can start work. But my lawyer strongly recommended not to change her status from H4 to F1. My PD is 24 March 2005 EB2. Lawyer told me that it might cause a problem for my wife to get the GC on her I-485 application. Lawyer said some of her clients got through without a problem and some of her clients have problem regarding status change from h4 to f1. Fianlly i decided not to take that risk. I'm still waiting to file I-485.

I am planning to go to the USCIS office tomorrow for media coverage. Any one in the DC area willing to join? This would be between 10 am and 1 pm. send me a pm with your name, number for more info. I really want to hear from the people who were ready for the protest in DC. This is a good opportunity to explain what has happened and the root cause of the issue.

Let me tell you I am as anxious and frustrated as you all "July 2 filers, no action yet" are. But I am thinking about it a bit calmly, rather than thinking of doing something so that I feel that I have done something (i.e. complain, write to congressman, etc.). Expressing my anger by saying they should have done this or that, does not change the situation. I believe USCIS is working, as expected, with the capability/attitude of a government worker, treating our filings (which are so important to us) just another government office paper work. Best is just to wait for another 10 days, and if nothing is heard by then, take action as per procedures.

Hello,
I have heard of the TERM 'Interfiling' to port your priority date from EB3
to EB2. This i hear happens when your 485 is pending with USCIS and
you have an EB2 labour with current PD date. So you transfer the PD using Interfiling.
Any one any thoughts or have you done this ?

Not sure why you need it? But I guess you gotta start a new process (Pre-Labor Work incl. ads+Labor EB2+I140,etc.) from the beginning.

As per my knowledge, one can't file I485 application until and unless priority date is current. How come this reporting is showing 485 application count of EB2 after Aug 2007 priority dates.
As per FAQ's (RED text in above post) these numbers are based on priority dates
These applicants might have married someone from a non India/China country and thus even though they were born in India, can file I485 due to a different country of chargeability

Also skipped Luis Gutirezze .. He was supportive in sub committe hearing last time .
Aide from Rep Chris Cannon took my name and no and she told me some one will get back to me as she is not sure about bill.

Congrats!!!! Can you please tell the SR process? Do we have to tell the reason why we want SR on the case? If yes, what was your reason to open SR? Thanks!

Got my receipt today. Till friday i wasn't in there sytem, they told me to call after 1 month n today my company lawyers got the receipt. So guys hold on.... :-)

We have no idea how many are legally porting from EB3 to EB2. I am sure many are trying but the data is not available. I dont know how you will move forward without such information.

Finally I got the CPO email today. After 10 years (first GC was filed in 2001), it was our turn today. I received for me and my wife both.
