So, even if USCIS now decides to stop processing/approving AOS based on the limited number of available visa - my understaning is that "we" are at least on top of the list and once visa become available again, the AOS will be approved - so, in worst case another three to four months wait? After five years of processing time(s) I can live with that...
Another question that came up was once the AOS was not approved, do you have to file again or does the current dis-approval have any negative effect on the process (except for of course the wait time)?

Today, I got a phone call from an IO at 7:45 am waking me up from my sleep. She said she was following-up on my request to the Senator to get a case update. She told me that my case is in transit to an officer from the holding facility.
This is the same status I got from my Infopass almost 10 days ago. How long does the case go from in-transit to assigned to an officer?
Is this common to get phone calls like this? She did give me her phone number and asked me to follow-up if I don't hear back in two weeks. Anyone experienced a similar situation?

What the employers are doing seems illegal. Govt issues us this card for a lot of money, and now we can't use it for work?
I agree. I was wondering why legal needs to be consulted for EADs.
But then this company is fully aware of of EADs and AC21 requirements. I think legal gets involved to ensure job codes are matching, etc., which would make sense. The applicant may not have completed 180 days, may be applying for a different job code, etc. They do invest a lot of money on an employee during the first year and they obviously do not want to end up losing that investment due to immigration issues, something they can avoid.
But this is something I was not aware of until today. The good thing is most employers are receptive to EADs which is good.

For those of us who have become "current" with the latest VB movements, I have some discouraging news for you: at least for the Nebraska Processing Center, the current processing date for an employment-based I-485 has retrogressed from September to August,2006. Only a small step backwards but a step backwards all the same.

Not true. This was the most successful media campaign so far. The flower story was in the top 5 most viewed articles today on Washington Post, and is still number 4 in the most emailed. That counts a lot. A record number of media outlets and blogs have picked it up. Even USCIS posted a statement on its home page in response.. Of course there are going to be other stories to compete in the media... it is a big and eventful world after all..

We have learned that in all probability House Judiciary committee will finishing marking up HR5882 in the next committee meeting. The bill is likely to be brought to the House floor the following week. We have been told that if our bill(s) pass the House, Senate will include the language of the bill(s) in another Senate bill that has majority support. We must admit that the time is shot but its still possible.
We request everyone that starting monday, please call all the members of Judiciary committee. Thanks to the members who have already made phone calls to the lawmaker's office. We request you to please call again to show your support starting Monday.

You can't divide the quota into 5 categories. Any country is capped at 7% usage(unless there's a spillover). The ROW EB3 will definitely consume more than the X/5 as it is not a country but a collection of countries, with no country reaching the 7% limit. The only reason there are separate categories in for India, China, Philipines, Mexico are that they are the only countries with demand for more than 7% of the numbers in EB3. In case of EB2, it's only India and China needing more than 7%.

Do you know if WOM can be filed only when the PD is current. After reading this article i feel so.
PD has no effect on filing a civil action as visa bulleting is changing every month. My friend in Oregon got I-485 approval after filing Wom even though his PD is not current on the latest visa bulletin.

EB3 Porting could use up to 8K though, and new filing could be 2K
and EB2 I/C pre-07/2007 still have about 34K at the beginning of oct/2010
So it is even at most...
There are lots of uncertain
1. EB1 is now the biggest uncertainty
2. EB2 ROW
3. Porting
But EB1 and Eb2 ROW, EB2 I/c new fling (ppl who missed 07/2007 w/ PD before 07/2007) have to file in May to get it approved by Sept as processing time is 4 month.
So After May, from June to August, it is all spill over game for EB2 I/C
That is why i guess Charles is saying the trend is now, and will start use the numbers in May
If 44k is the available number for EB2 I & C then the PD will move upto Jun 2008 with out any doubt. Even with the porting of EB3 to EB2 is accounted for.
