    There are two waves of movement going to happen for EB2 this year. One starting in May and the other starting in July.

    The 12000 unused visa numbers from EB1 is not the total for the year 2011. It is almost certain that, this is the spillover from the first 2 quarters of 2011. Along with this, there are some numbers from EB2 ROW as well. The spillover will only get applied to all those countries which are retrogressed.

    12000 visa numbers would move mathematically the dates to somewhere in Sept 2006 for India and China Eb2. The porting from EB3 to EB2 is still a factor, but that won't exceed more then 1500 (which are ready to be assigned visa).

    In order to utilize these 12000 visa numbers, USCIS may possibly consider 15000 applicants so that they will get 12000 approvable, background check free and non-delayed cases.

    So, i think for EB2 the dates could move to either Oct/Nov/Dec of 2006.

    In July, the next wave of spill over could move the dates further into 2007.

    Man you made my day... atleast i can be happy for coming three weeks, then i will go back to normal after Visa Bulletin Copy/paste.

    My wife got the approval on Oct 5th...CPO mail was first followed by approval notice and I also got a CPO mail after 35 days of approval....strange and surreal it seems

    I may be wrong since my wife's case was separated.....But this was from my congressman's office who told me that the reason that her case is pending and delayed is because our case got separated during adjudication.

    After the infopass for me and my wife, we had multiple soft/hard luds and status changed to case moved to local office.
    Received mail that we would be called for interview.
    Wish they get this fast when the dates are current.

    On FEb 4th my wife and myself went for H1-B visa renewal interview at Chennai Consulate. Both visas got approved. My wife passport was returned with in 3 days. It seems they have found her petitition online. My passport stuck with consulate. I called consulate today, and they have asked me to call back next week end. She said they were not able to locate my petition online.

    How long it can take? 1 week or 2 weeks or 1 month? Please provide your experiences for those passports took more than 3 days. I have seen max 1 month in the forum.

    It was on Dec 2005 . Luftansa . Chennai - Frankfurt- Dallas . I was waiting for my boarding pass . I handed over my e ticket to the lady at the counter. Instead of issuing the boarding pass , she asked me about my H1B papers. I got confused . Why should I show my papers to this lady ? . Since it was my very first trip to US , I meekly showed her my papers.After that she had issued the boarding pass.

    Friends, you may think I am very meek.This was not my first overseas trip. I had visited Japan previously. I didn't want to have fight with her and start my journey in bitter taste from the beginning.

    50% rule - Does this cover only US Citizens or includes GC as well? not clear... may be senators didn;t think about GC folks in this bill... A lot of the companies, I believe will have 50% with GC holders/citizens/T1/OPT/Add any other visa category who can work.. Since the bill restricts only H1B/L1.

    There are some assumptions, I guess on above post, that americans are paid more etc... which is totally wrong... A lot of the folks in this community, I believe, based on my own experience are paid more or at par with american counterparts. (I guess, about the profitability, if you mean it in terms of less productivity, I agree with that.)

    I guess the genuine companies will move the H1/L1 staff abroad along with positions to meet this requirements if at all this becomes law. What that means is more job loss in US. (Whether US has 50% of total "high skilled" work force necessary to run the operations of all the companies is another important question... I do not think so, may be the senators are considering highschool dropouts to handle the "high skilled" jobs :), I read somewhere about a recent survey and only 27% of 25-45 age group of population has a college degree in all discipline. I will try to find the link)

    Over all, I see this move by senators as short sited and will prove disastrus to America in long run given the fact that no other country in the world is as dependent on technology / research and development as US.

    Good talent also needs to make up its mind as to which company to stick to. The "future job" labor petition is so full of holes that its misused lot more than its used.


    Its not so simple though. Even after finding a good company to stick to, you should not make up your mind to remain stagnant. When you work for about 5 years, you will be faced with a situation where you are asked to take on more responsibility.
    The way things are with the current process, if you want to progress in your career and take on a new challenge (eg: database programmer to a DBA/architect), that would require a new LCA since there is a significant change in the responsibilities.
    Also at big companies, there are several lines of businesses which are structured as if they are companies by themselves. If you want to shift between LOBs within the same big company, that would also require a new LCA.

    The competitive angle did occur to me. There is no reason a business should not look for ways to cut costs. However, this is a question of fairness & legitimacy. A L1 visa person living in a low cost country and coming here temporarily on short-term assignments can make do with lower wages because he likely does not have to support a family here at the US cost of living, and L1 spouses can work. This is not fair to a H1 with same skills whose H4 spouse cannot work, and for the same reasons it is not fair to USC/GC folks. Isn't that why we currently have all this labor certification processes and DOL laws? Those laws are designed to level the playing field. It is not easy for the company to outsource entirely, so they break the law by abusing the visa. Why should we not act to stop this illegitimate corporate action?

    If that does not sound reasonable, let me ask you this: Why should USCIS and law-makers even consider taking steps to address green-card backlogs, adding resources to process more cases more quickly when they can just sit there and collect fees from you for visa / EAD renewals?

    Agreed on your point. But there are other discriminations at workplace such as , age, race, sex and sexual harrassment. Those who complain about it effectively terminate their careers. If you want to go , complain against this L1 misuse fine, but you are not going to get mileage, maybe some bad breath and bad publicity and eventual loss of reference & job. If your company / client has decided they do not want to persist with you, there are 101 ways they can get rid of you, legal or illegal, my suggestion is, if you were exposed,

    can L1fraud hold his head high in front of his client and still ask for reference with no sense of guilt in future? If not, he has lost half the game but now wants to lose the other half in a self destructive manner.

    in my case i got no slip..whenever i call consulate new delhi they say still under admin processing ?? my lawyer checked with DOS..DOS had sent approval on jan 25th..still under proc at embassy !!

    NOT SURE WHY ?? this delay is ??

    Dont do it. Why? you might ask?

    Just think, if you use a lawyer you might have to spend another 500 to 1500 bucks. But you will have a no problems in filing (especially with out errors).

    We have spent thousands of dollars so far in getting a GC and at this stage dont mess up to save a few paltry bucks.

    You may be finding that your lawyers are'nt approachable a this time. But this is the case with everyone, as they are getting hundreds of calls.

    Get a lawyer, fill the application and leave blank and stick notes at which ever field you didnt understand. The lawyers will definitely look into the applications and file it quickly. make sure you tell your lawyer to use the overnight courier to file and bill you the same.

    Just talked to a recruiter from a software giant.

    She specifically wanted to know if I was on EAD and if yes, unfortunately they cannot hire EADs during the fourth quarter (now) due to hiring budget limitations that are typical during the fourth quarter.

    Q: Why does budget come in to picture here?
    A: Because policy requires the legal dept to be consulted for visa holders and EADs which means additional hiring costs plus time.

    But she said once the fourth quarter passes, EAD hiring is not a problem.

    Folks, we should not remain quiet about this. The regulations make it illegal for an employer to discriminate based on immigration status. We should politely and respectfully pursue the authorities regarding this matter.

    I would encourage you to point out the USDOJ guidelines (posted earlier) to the "software giant" employer and also contact the OSC worker hotline.

    Also, would it be wise for people to post name of the company who are known to have such policies? We got one - CapitalOne from earlier posts.

    Job Zone 4 does not automatically translate to EB3. Even though the title maybe EB-3, if the requirements exceed normal requirements for jobs in Job Zone 4 then after a (successful) business necessity audit the candidate maybe able to file in EB2.
