So for EB-3 we have 1630 from 01, and 8300 from 02 and 12500 from 03..how long would this take to clear given EB 3 allotment??. every year??.
With horizontal spillover, things don't look good for EB3-I in 2009-2010.
However, 2010-2011 things should be great for EB3-I, as EB2-I & C would be pretty close to current (or) current.

You are right about members working on understanding the law in this forum and thrashing out arguments to make them fool proof. Instead I find people getting incensed at each other and creating a destructive environment instead of a constructive one.
As far as immigration lawyers go - they have no incentive to file a lawsuit to get a correct interpretation as they donot stand to gain whatever way the law is interpreted. Also while there definitely are a few smart immigration lawyers- the run of the mill ones are no better than paralegals. I'm not sure I should be saying the above but my experience points to that.

Just now (12.30 PM EST) I got a mail from USCIS saying your application has been approved. I didn't do anything (never opened SR or contacted Senator) but last week I did had an info pass appointment which was useless. MY PD was Feb 2005 EB2 INDIA (The fun part is My AP and EAD are still pending for over 4 months)

Its interesting that July 2nd apps have not been receipted yet. I made two applications (based on the same I-140 from TSC because of the July fiasco), one on July 2nd and one on July 19th.
You can see the first application details in my signature. My second app's checks cleared the bank on 09/12/2007. This is the application that reached NSC on July 19th - the receipt is from TSC.

Hi,
I do not have medical records to prove that I have taken some of the vaccination that is mandatory for the medical test. However, I do have taken those and my Doctor back in India has those records. Is there a way people know that these records in "any format" / a "specific format" can be faxed or fedexed here and can be used?
Any help will be highly apprciated.

Got an InfoPass scheduled, and created a SR. This is taking way too long, and now April + May approvals are rolling in...

I am sure you will get it. Response to a SR takes about 10-15 days. I opened my second SR on Aug 30th and got the response today. I was approved on Sep 7th.
Things i did from Aug 1st:-

POJ method can be used for all cases that are current and in the processing window...just keep on trying ur luck and I am sure you'll land a decent CSR who will be much much more useful and worth your trials and efforts.

That's exactly what I wrote a few posts above. I think the more basic question is - What does 485 inventory mean? Is it already filed 485 numbers or "can be filed based on approved I-140" numbers?
To the OP: Can you provide the link from where we can open the PDF instead of just throwing the PDF open. Maybe that will provide a better context to the numbers.

Thanks for your wishes. As much as I feel it as a journey I still consider myself lucky seeing so many people with PDs earlier than me both for EB2 and EB3 still languishing. We all consider FIFO to be fair and it is hard for us to decipher why it is not followed by DHS.
My suggestion to you all is that if you are told that your case is with an IO ask him or her if an email can be sent to that IO that you are concerned. This is exactly what I told Janet on Friday, one of the good CSRs from TSC. I had told her that knowing a case is with an IO is of no help to me if that IO is on vacation or is sick or is not aware that the case is current.
Also if you guys had followed my never ending streak of mails, I had mentioned that my wife had got a call from a CSR at DC probably in response to her SR that I opened or my concerned and frustrated mail to Napolitano...she was told that her case is with an IO and that since the case was transfered her Biom had not been uploaded and that she is ordering new Biom request and she should get it done...I had told her that by the time we receive it the visas may be over and also how come I am approved....moral of the story is "THEY KNOW NOTHING" as Jim Cramer used to say.
The only person I found reliable was this Ms Beck at TSC who I was fortunate to get hold of exactly 2 weeks back and she had told that we don't need new FP and Biom it just needs updating by the IT dept and she is sending a request to that effect...I had asked her how long should it take and she had told me 2 weeks..she also told me you will get your card b4 your wife.....and she may be a bit delayed but will get approved.
So guys from TSC keep trying and hope to get this Ms Beck...you can alway ask the person's batch number and name and don't waste your time if you get someone else.

Enjoy greenhood..........no luck yet for my wife...But she got a call from USCIS office of Wash DC that it is the biometrics that is holding her approval...they are issuing a biometrics appointment....I told so far she had been issued Biometrics appointment thrice and we have not received anything.
Also if I got approved without biom availability how come she is not....she is giving crap that our job is approving the primary applicant....I told her that none of my friends have got approval just for the principal they all got approved together.
I told her Biom does not hold approval ...she was adamant we can't approve her w/o that.

Jan 18: received a call from the consulate, said the petition number on the application is incorrect, and I need to resubmit the approval notice with fresh DS 156/157 at the Bangalore VFS drop box.
Has anyone else been through the same situation?
I checked a copy of the original DS-156/157, and there was no place to enter receipt number. The only place I could see was where the VFS pre-screening guys enter this number manually (first page DS 156 top right corner).
If this is due to their mistake, I will be very angry and will convey this to the consulate general.

I have an appointment at Kolkata on the 11th. Scheduled to fly back to US on the 26th. Considering Martin Luther king Jr day it will be 9 working days. After seeing the PIMS delays, I am seriously considering return back on AP. Cannot take the risk of delaying the flight as I dont have vacations to hang around and wait for PP.

So, what would you guys advise me to do:
(1) Go to Kolkata (with my 485 receipt notice, original) and return before my

If they are indeed genuine then there should nothing be worried about. They would come out clean. Remember, the whole labor certification is to protect the interest of American people and not foreign workers like you and me.

A friend of mine forgot (!!) :confused: to renew his EAD when it expired last September. He then applied for renewal 60 days after the expiration date and got his new EAD without any problem, no questions asked!
I filed for my own renewal about 90 days before the expiration date and when about 85 days had passed and I was getting worried, I called USCIS and was told: " Do you need the card to show your employer that you are legal? No? Then, don't worry about it. As long as you applied on-time, you are fine." I actually received the EAD five days after the expiration date...
These two experiences are from California Center.

I changed my employer and the new employer may ask for a new one. But I'm hoping that I might get one in less than 3 months. Let's see

I would like this idea to materialize but I am just wondering how it is practical.
Except for waiting for a visa number to be available all other delays are due to the time that it takes to process a case (and also due to the country quota). In labor stage, DOL determines if there is any citizen who fit in the labor description and who is looking for a job. In 140 stage, USCIS determines if the company is in good standing and has the ability to pay. In final stage, the candidate’s biometrics is taken and his background checked. All these are essential process in adjudicating a GC case in the employment category. I just do not how all these can be surpassed and candidates handed over a GC, let alone citizenship.
Allocating recaptured visa numbers and following a sensible order is more practical in eliminating some of the delays…

I came to America in pursuit of opportunities, educational and economic. I have stayed here <<<NUMBER OF YEARS>>> years, received a graduate degree in <<<FIELD OF EDUCATION>>>, contributed positively to the <<<INDUSTRY OF WORK>>> industry, bought a home and become a part of the society I live in. I have found that the US economy yearns for my skills as a <<<JOB TITLE>>> and would like me to stay and contribute as a permanent resident. Yet the US immigration system has failed to reconcile with this need. I stand in line to become a permanent resident in the US and face a decade long wait before my turn will appear. The specter of such a wait poses a question I have to answer soon. Do I chase my dreams as an innovator in another economy, unburdened by the indignity of a decade long wait? Or do I shackle my aspirations for the future promise of a life in America?
Mr.President, I believe you can remove the burden of difficult choices these questions impose by helping me believe that America welcomes and values my skills, talent and aspirations. You can help rekindle the hope that that I can wait for my turn without compromising on my right to a fair and dignified immigration process. Mr.President, you can restore my faith in the immigration system and in America by implementing administrative reforms to:
* Recapture administratively the unused visas for permanent residency to fulfill the congressional mandate of 140,000 green cards per year.
* Revise the administrative definition of "same or similar" to allow slight additional job flexibility for legal immigrants awaiting adjudication of adjustment of status (I-485) petitions.
* Allow filing of Adjustment of Status (Form I-485) when a visa number is not available.
* Implement the existing interim rule to allow issuance of multi-year Employment Authorization Documents (EAD) and Advance Parole.
* Allow visa revalidation in the United States.
* Reinstate premium processing of Immigrant Petitions.
The above reforms are simple and yet can have far-reaching effects on my life along with those of a half million others. These are urgently needed to fulfill your stated goal of attracting and retaining highly-skilled legal immigrants from around the world, eliminating bureaucratic inefficiency, and improving the lives of future Americans already living and working legally in the United States.
